Expert determination: no way out!

Expert determination is regarded as a quick and cheap method to reach a conclusion on a discrete dispute. This week, in Owen Pell Limited v Bindi (London) Limited, the Technology and Construction Court clarified the potentially binding nature of an expert determination. The court made it clear that the circumstances in which the dissatisfied party can avoid the decision are extremely limited, unless the agreement states otherwise.
