New Guidance on Data Protection Issues & TUPE Transfers

Under the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE) an employer has an obligation to provide certain information about their employees on a business transfer. Since the introduction of this obligation in 2006, there has been concern about how this fits with data protection obligations. The Information Commissioners Office (ICO) has finally published new guidance to help remove the apparent conflict between these competing obligations.
