The High Court has ruled on one of the most fiercely debated questions arising out of the Landlord and Tenant (Covenants) Act 1995.
In Good Harvest Partnership LLP v Centaur Services Limited, the court held that a guarantee given in an Authorised Guarantee Agreement by an outgoing tenant's guarantor to guarantee performance of the lease by the assignee was void.
