Citiworks: the end of private electricity distribution networks?

The so-called "Citiworks" case has gained a great deal of notoriety since the European Court of Justice (ECJ) delivered its judgment last month (22 May 2008).
The case - citiworks AG v Sächsisches Staatsministerium für Wirtschaft und Arbeit als Landesregulierungsbehörde(C-439/06), to give it its full title – concerns access to electricity distribution networks, and casts doubt over the way in which unlicensed electricity distribution networks are currently regulated in Great Britain.
